ZONEIT DOMAIN NAME PROXY AGREEMENT

Please read this Agreement carefully, as it contains important information regarding your legal rights and remedies.

1. Overview​

This Domain Name Proxy Agreement (this "Agreement") is entered into by and between Zoneit ("Zoneit," "we," "us," or "our") and you ("you," "your," "User," or "customer") and is made effective as of the date of your electronic acceptance. This Agreement governs your use of Zoneit's domain privacy services ("Privacy Services"). This Agreement is subject to Zoneit's Universal Terms of Service Agreement and any other agreements expressly incorporated by reference.

2. Description of Privacy Services​

When you subscribe to Zoneit's Privacy Services, Zoneit will display its contact information in the publicly available "WHOIS" directory in place of your information. Zoneit shall keep your name, postal address, email address, phone, and fax numbers confidential, subject to Section 4 of this Agreement. The following information will be displayed in the "WHOIS" directory:

  1. Zoneit's name as the proxy registrant and proxy contact information

  2. Proxy contact details for technical, administrative, and billing contacts

  3. The domain name servers you designate

  4. Original registration and expiration dates

  5. The identity of the Registrar

3. Retention of Domain Registration Rights​

Although Zoneit will appear as the registrant in the "WHOIS" directory, you retain full benefits of domain name registration, including:

  1. The right to sell, transfer, or assign the domain name registration

  2. The right to control domain name usage and nameserver designation

  3. The right to cancel domain name registration

  4. The right to cancel Privacy Services

  5. The right to renew domain name registration

4. Your Obligations​

You agree to:

  1. Provide accurate and current information for all contact types (registrant, technical, administrative, billing)

  2. Update Zoneit within three (3) calendar days of any changes to your information

  3. Respond within three (3) calendar days to inquiries from Zoneit regarding your information

  4. Timely respond to forwarded correspondence regarding your domain

  5. Provide government-issued identification when requested for verification

  6. Allow Zoneit to act as your Designated Agent for privacy service changes

5. Disclosure of Information​

Zoneit reserves the right to disclose your personal information and/or cancel Privacy Services:

  1. When required by law or public safety concerns

  2. To comply with legal process or ICANN policies

  3. To resolve third-party claims regarding domain use

  4. If you breach this Agreement or other Zoneit policies

  5. To protect the integrity and stability of domain registration systems

  6. If the domain is used for illegal activities or infringes on others' rights

6. Communications Handling​

  1. Email Forwarding:

    • Zoneit will create a private email address for your domain

    • You may choose to have all messages forwarded, filtered for spam, or blocked

    • Zoneit is not responsible for undelivered or filtered messages

  2. Postal Mail:

    • Zoneit will forward legal notices and certified mail

    • Other mail may be discarded or returned unopened

    • You waive claims for unforwarded communications

7. Limitation of Liability​

ZONEIT SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM:

  1. Disclosure of your personal information

  2. Service interruptions or delays

  3. Communication forwarding failures

  4. Unauthorized account access

  5. Failure to renew Privacy Services

  6. Any acts or omissions by you or your agents

8. Indemnification​

You agree to indemnify and hold harmless Zoneit, its officers, directors, employees, and agents from claims arising from:

  1. Your use of Privacy Services

  2. Violation of this Agreement

  3. Domain name disputes

  4. Third-party rights infringement

9. Warranty Disclaimer​

PRIVACY SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. ZONEIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Governing Law​

This Agreement shall be governed by the laws of Victoria, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia.

12. Acceptance of Terms​

BY USING OUR PRIVACY SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT AND ANY MODIFICATIONS THEREOF.
